いわゆる「先進国」が強調する普遍的人権等の近代法は、全人類が納得する普遍性を本当に持っているのか。それともそれは、ある地域、ある時期の人類の一部だけが持つ単なる信念に過ぎないのか。比較法文化論I では、以下のようなテーマを材料として、この問題について考えてみる。

・姦通罪（日本、韓国、イスラム法）。
・韓国の同姓同本禁婚制（同姓不婚）。
・近代法の誕生におけるプロテスタンティズムの役割、マックス・ウェーバーの分析。
・イスラム法における特徴的な制度：背教者離婚訴訟、一夫多妻、マフル。
・イスラム原理主義者によるテロ行為のイスラム的解釈。
・アメリカ法と宗教：進化論訴訟と妊娠中絶をめぐる争い。
・同性愛と法：戦国時代以来の日本での位置づけ、欧米における刑罰と同性婚、西欧法と
東欧法との違い。
・食べ物と正義、人間と動物の関係。
・日本法と宗教。
・ハプスブルク統治下のボスニアにおける近代法継受、イスラム法文化への近代法移植。
・ハンガリーの「反LGBT 法」と「ヨーロッパ的価値」。

Comparative Legal Culture I (will be held in Japanese)

The developed countries" emphasize the value of the Modern Law including the human rights as a universal justice, which should be accepted by all on the planet. Are they right in saying so? Or is this only the belief of a part of human beings at a restricted time and in a restricted area? We will discuss this problem out of the followings.

・Adultery (Japan, Korea and Islam)
・Prohibition of marriage between man and women with the same surname in Korea
・The role of the Protestantism in the birth of the Modern Law, the analysis by Max Weber
・ Some particular legal systems in Islam: a divorce case of an apostate, polygamy and the Mahr
・ Islamic interpretation of the Jihad or terrorism by Islamic fundamentalists
・ Religion and American law: Trials for Darwinism; Disputes as to abortion
・ LGBT and law: Situation in Japan after the period of civil wars up to now; punishments and same-sex marriage in the Western countries; the difference between the Western and the Eastern Europe
・Food and justice, the relation between human and animals
・Religion and Japanese law
・The reception of the Modern Law in Bosnia under Habsburg rule: the transplantation of the Modern Law into Islamic legal culture
・ “Anti LGBT Laws” in Hungary and“European Values”
